Significant changes were made by the Ministry of Trade with the Regulation Amending the Price Label Regulation (“Regulation”), which was published in the Official Gazette on 18.02.2022 and entered into force on 01.03.2022.

What Have the Changes in the Price Label Regulation Brought?

Regarding the definitions article;

  • The Ministry was updated as the Ministry of Trade,
  • the term “label” has been changed to “price label” and the information required to be included in the labels has been removed from the scope of the article and the definition of the price label has been added,
  • in the definition, it has been clarified that the “unit price of the good” is the price including taxes, which is expressed with the net amount of the unit of measure that is suitable for the type of the good according to the criteria specified in the article,
  • it was regulated in the definition of “sale price” that calculations should be made on the net amount of a good sold,
  • the term of “net quantity” was defined as “the amount of the packaged goods excluding the packaging material and other materials packaged together with the goods”.

Moreover, information that are obligatory to be included in the label and lists, such as place of manufacture, distinguishing features, sales price including taxes, the deposit fee must also be included in the labels and lists separately from the sales price of the packaged goods and all information must be written in Turkish.

The labels placed on the goods offered for retail sale may also be placed on the packaging or cover of the goods with an appropriate method.

In parallel with the amendment made with Regulation Amending the Regulation on Commercial Advertising and Unfair Commercial Practices, in determining the sales price of the goods or services subject to discounted sales before the discount, the lowest price applied within 30 days prior to the application of the discount must be taken into consideration. Thus, the discount price and the sales price before the discount will be indicated on the labels on this basis. When calculating the discount amount for perishable goods such as fruits and vegetables the price before the discounted price will be taken as the basis.

The burden of proof that the discount amount is calculated in accordance with the amendment lies with the seller and supplier of the goods and services.
